World Intellectual Property Organisation (WIPO) is the administrator of the Madrid Protocol. It is a filing system through which a Trademark Application is registered in all participating countries in a single application. The Madrid protocol has 124 member countries as of March 2021. Before filing an application, it is important that you conduct a search to find out similar or already registered marks, especially in your business area, recorded in the Singapore Registry of Trademarks or through the IPOS search tool. This tool assists in searching for trademarks that are taken in Singapore. This helps to ensure there are no existing similar or identical mark to the one you intend to register.
You can trademark a word, symbol, device, phrase, Trademark Business Name or even a colour and anything else that distinguishes your mark and offerings from other parties. In order for your mark to meet the registration criteria, it must be able to be represented graphically, be distinctive, and not be descriptive and confusingly similar to other marks. - Create a distinctive mark for your business that does not consist of common names, geographical location names, is not a descriptive term.
- Identify the applicable classes for your goods and services. Singapore follows the International Classification of Goods and Services with a total of 34 classes of goods and 11 classes of services.
- Conduct initial search to identify existing similar marks using the IP2SG platform.
- Fill a trademark application form. While filing the application form, it is important to ensure that you have provided the following:
- Statement describing your request for a registration.
- Your name and address
- Graphical representation of the mark
- List of classes that you wish to register in
- Declaration of the use of proposed trademark
5. Pay the application fees
6. Wait for the examination and formalities stage to end and respond to any objections.
7. Once successful, receive a registration certificate after the resolution of oppositions.
